PART 2: TERMS OF USE

Article 1 - Purpose

These Terms of Use govern access to and use of the Tetikasa platform, a project management service designed for freelancers and their clients.

Article 2 - Definitions

  • Service: the Tetikasa platform accessible at https://www.tetikasa.app
  • User: any person accessing the Service
  • Member: a User with a registered account
  • Organization: a workspace created by a Member
  • Client: a person invited to view a project

Article 3 - Acceptance of Terms

Use of the Service implies full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the Service.

Article 4 - Registration and Account

4.1 Account Creation

To access the Service, you must create an account by providing:

  • A valid email address
  • A secure password

You warrant the accuracy of the information provided.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Any activity carried out from your account is presumed to be yours. In the event of a security breach, contact us immediately.

4.3 Account Deletion

You may delete your account at any time from the settings. This action is irreversible and results in the deletion of your data (subject to legal data retention obligations).

Article 5 - Description of the Service

Tetikasa allows freelancers to:

  • Create and manage projects
  • Organize tasks and milestones
  • Share progress with their clients
  • Communicate via comments
  • Manage invoicing and payments

Article 6 - Subscriptions and Pricing

6.1 Plans

The Service offers various subscription plans whose features and pricing are available on the website.

6.2 Payment

Payments are processed securely by Stripe. Subscriptions are billed monthly or annually depending on the chosen plan.

6.3 Renewal

Subscriptions are renewed automatically. You may cancel at any time from your account. Cancellation takes effect at the end of the current billing period.

6.4 Refunds

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period. However, we may review requests on a case-by-case basis.

Article 7 - User Obligations

The User agrees to:

  • Use the Service in accordance with its intended purpose
  • Not infringe upon the rights of third parties
  • Not distribute unlawful, defamatory, or inappropriate content
  • Not attempt to compromise the security of the Service
  • Respect intellectual property rights

Article 8 - User Content

8.1 Ownership

You retain ownership of your content. By uploading it, you grant us a limited license to display and store it within the scope of the Service.

8.2 Liability

You are solely responsible for the content you publish. We reserve the right to remove any content that violates these Terms.

Article 9 - Intellectual Property

9.1 Trademarks and Logos

Tetikasa, its logo, and its graphic elements are protected trademarks. Their use without authorization is prohibited.

9.2 Code and Features

The source code, architecture, and features of the Service are protected by copyright and/or trade secret law.

Article 10 - Liability

10.1 Availability

We strive to ensure the availability of the Service 24/7, but do not guarantee uninterrupted availability. Maintenance may be performed.

10.2 Limitation of Liability

To the extent permitted by law:

  • We do not guarantee that the Service will meet your specific expectations
  • Our liability is limited to the amounts paid by you during the preceding 12 months
  • We are not liable for indirect damages, data loss, or loss of profits

Article 11 - Data Protection

The collection and processing of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms.

Article 12 - Amendments to the Terms

We may amend these Terms at any time. Amendments take effect upon publication. In the event of a substantial change, you will be notified by email. Continued use of the Service constitutes acceptance of the updated Terms.

Article 13 - Termination

13.1 By the User

You may terminate at any time by deleting your account.

13.2 By Tetikasa

We may suspend or terminate your account in the event of:

  • Violation of these Terms
  • Fraudulent behavior
  • Non-payment

Article 14 - Governing Law and Disputes

These Terms are governed by French law.

In the event of a dispute, an amicable resolution will be sought first. Failing that, the courts of Nantes shall have jurisdiction.
